1. ELIGIBILITY FOR 21 DAY DELIVERY:
1.1 The "21 Day Delivery" service provided by Marfa Cabinets is subject to specific eligibility criteria. The following types of products are NOT eligible for this service:
a. Painted products.
b. Any cabinet door other than SLAB.
c. Designs that require special accessories.
d. Designs utilizing pocket doors or glass/aluminum doors.
e. Designs requiring complex, custom-made cabinetry solutions (for clarity or if uncertain, it is advisable to consult in advance).
2. REQUIREMENTS FOR 21 DAY DELIVERY:
2.1 To be eligible for our "21 Day Delivery" service, the Customer's project must meet the following requirements:
a. The cabinet order should utilize flat panel material chosen from the "Approved 21 Day Colors" list, which includes all of the C1 - C2 colors sold by Alvic USA LLC or Salt Inc, excluding all C3 colors and painted, fluted, or shaker material. Please note that Marfa Cabinets LLC reserves the right to modify this list at any time.
b. All measurements for the project must be confirmed by the individual responsible for approving or installing the cabinets.
c. A comprehensive appliance list must be provided in full.
d. Any additional information related to the project, such as countertop, plumbing, backsplash, or any other necessary details, must be provided as requested.
e. If the Customer has a qualifying deal that meets the "21 Day Delivery" criteria, they are required to notify their assigned sales manager immediately. In such cases, Marfa Cabinets will bypass the preliminary contract phase and proceed directly to a fully signed and paid final contract.
3. DELIVERY TIMELINE:
3.1 The "21 Day Delivery" timeline refers to 21 business days, excluding holidays and weekends, from the later of the date of the final contract sign date or the final payment date.
4. GENERAL TERMS:
4.1 Delivery timelines may vary based on the complexity of the project and the accuracy and timeliness of the information provided by the Customer.
4.2 Marfa Cabinets LLC reserves the right to assess the eligibility of any project for the "21 Day Delivery" service and to decline the service if the criteria are not met.
4.3 Any changes or modifications to the project that deviate from the initial agreement may impact the delivery timeline and will be subject to reevaluation.
4.4 In the event of unforeseen circumstances or factors beyond Marfa Cabinets' control, Marfa Cabinets is not responsible for delays in delivery.
5. PAYMENT OBLIGATIONS:
5.1 The final contract must be signed and paid in full as per the terms outlined in the agreement.
6. INSTALLATION AND READINESS:
6.1 Responsibility Scope for Installation: Marfa Cabinets is solely responsible for the installation of the cabinets as per the agreed design and specifications. However, it is crucial to note that our installation services do not include the demolition or removal of existing cabinets, countertops, and appliances.
6.2 Site Preparation Requirements: The installation site must be fully prepared for our team's arrival. This preparation includes but is not limited to: a. Complete removal of old cabinetry, countertops, and appliances. b. Ensuring that the walls, floors, and installation areas are free from damage and are structurally sound. c. Provision of a clear workspace free of debris and other obstructions. d. Ensuring that all electrical and plumbing requirements are met and are in accordance with local building codes.
6.3 Measurement and Verification: Prior to installation, a final measurement and verification process will be conducted by our team. The Customer is responsible for ensuring access to the site for this purpose.
6.4 Installation Scheduling: The Customer must agree to a scheduled installation date and time, which will be communicated in advance. Any delays or changes to the schedule must be communicated to Marfa Cabinets at the earliest opportunity.
6.5 Damage Liability: Marfa Cabinets will not be liable for any damages to the property that are not directly caused by our installation team.
6.6 Risk Assessment: Prior to installation, a risk assessment will be conducted to identify any potential hazards. The Customer must cooperate fully with this process.
6.7 Building Codes and Regulations: All installation work will comply with relevant local building codes and regulations.
6.8 Permit Requirements: The Customer is responsible for obtaining any necessary permits required for installation.
6.9 Inspection and Approval: Upon completion of installation, an inspection will be conducted with the Customer for approval and to address any immediate concerns.
6.10 Cleanup and Waste Disposal: Marfa Cabinets will ensure that the installation area is cleaned up after the work is completed. However, disposal of old materials and waste is the responsibility of the Customer.
6.11 Guarantee Terms: Marfa Cabinets provides a guarantee for the installation work, covering workmanship and material integrity for a specified period.
6.12 Voidance of Guarantee: Failure to comply with the site preparation requirements, as outlined in Section 6, will result in the voidance of the installation guarantee.
7. GOVERNING LAW:
7.1 This Agreement shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law principles.
8. ENTIRE AGREEMENT:
8.1 This Agreement constitutes the entire agreement between Marfa Cabinets and the Customer with respect to the "21 Day Delivery" service and supersedes all prior or contemporaneous understandings or agreements, whether written or oral.
9. "APPROVED 21 DAY COLORS":
9.1 The "Approved 21 Day Colors" list, which determines the eligibility for the "21 Day Delivery" service, includes all of the C1 - C2 colors sold by Alvic USA LLC or Salt Inc, excluding all C3 colors and painted, fluted, or shaker material. It is important to note that Marfa Cabinets LLC reserves the right to modify this list at any time.
Customers opting for the "21 Day Delivery" service should refer to this list to ensure that their chosen panel material complies with the specified colors and material types.
In the event of any changes or updates to the "Approved 21 Day Colors" list, Marfa Cabinets LLC will make reasonable efforts to communicate such modifications to affected parties.
